If your spouse is abusive to you or your children, you may seek a temporary restraining order.
Step 1: Fill out restraining order forms:
- Request for Order, DV-100;
- Temporary Restraining Order, DV-110; and
- Notice of Court Hearing, DV-109.
Step 2: To protect your children, fill out custody forms:
- Child Custody, Visitation, and Support Request, DV-105; and
- Child Custody and Visitation Order, DV-140.
Step 3: For child support fill out:
Step 4: For spousal support fill out:
- Income and Expense Declaration, FL-150; and
- Spousal, Partner, or Family Support Order Attachment, FL-343.
Step 5: Contact you CA county clerk to determine if there are any other required local forms
Step 6: File all the forms and wait one day for the judge to issue the temporary order.
Pick up the order and give copies of the order to protected persons.
Step 7: Have someone serve your spouse and file proof of service.
File Proof of Service, DV-200. Make copies and give them to protected persons.
Step 8: Attend hearing
Come prepared with evidence of domestic violence.
Step 9: Serve your spouse
Have someone serve your spouse by mail and file proof of service if your spouse attended the hearing OR the order is the same as the temporary order. DV-130 & DV-250.
Have someone personally serve your spouse and file proof of service if your spouse did not attend the hearing AND the order is different from the temporary order. DV-130 & DV-200.
