The following is a general summary of many family law forms used in California. Many court requirements are excluded and you should contact an attorney for complete information on which forms and other divorce papers are necessary, how to fill out the forms, what to do with the completed originals and copies, and whether you must notify your husband or wife.
FL-100 – Petition
The Petition (FL-100) identifies the parties and requests a dissolution, legal separation, or nullity. It must be filled out and filed in a court with jurisdiction over the matter. The Petition contains certain information such as the date of separation, listing of minor children of the parties, assets and obligations.
FL-110 – Summons
The petitioner fills out Summons FL-110 and submits it to the court for issuance when the Petition is filed. Service of the Petition and Summons is used to notify your spouse of the court proceeding.
FL-105/GC-120 – Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act
FL-105 notifies the court of other proceedings concerning children of the action. If there are minor children of the action FL-105 must be filled out and attached to the Petition and Response.
FL-160 – Property Declaration
The Property Declaration (FL-160) is used as an alternative to listing assets and obligations on the Petition or Response. Property of different classification such as community and separate property must be filled out on separate forms. FL-160 is filed and a copy served on the spouse.
FL-117 – Notice and Acknowledgment of Receipt
When service is completed by mail, two copies of this form are mailed by the petitioner with a self-addressed stamped envelope to the respondent along with the Petition and Summons who then signs and returns FL-117 to the petitioner. The respondent is not required to return FL-117 but failure to do so except for good cause requires the respondent to pay reasonable expenses to the petitioner for costs of service in another manner.
FL-115 – Proof of Service of Summons
FL-115 is filled out by the person who served the respondent.
FL-120 – Response
The Response (FL-120) states the position of the party served with the Petition. Ordinarily it should be filed and a copy served within 30 days after service of the Petition and Summons.
FL-150 – Income and Expense Declaration; FL-155 – Financial Statement (Simplified)
Either of these forms provides the court with information regarding the finances of the parties.
FW-001/002 – Request to Waive Court Fees
These forms are used when the applicant meets certain requirements to waive court fees.
FL-350 – Stipulation to Establish or Modify Child Support and Order
This form contains an agreement regarding child support.
FL-300 – Order to Show Cause; FL-301 – Notice of Motion; FL-305 – Temporary Restraining Order; FL-310 – Application for Order and Supporting Declaration; FL- 320 – Responsive Declaration; FL-340-4 – Various Orders
These forms are used to obtain certain court orders. FL-150 or FL-155 is used when financial relief is requested such as child support, spousal support, and attorney fees. FL-191 is used in certain child support orders.
